i just read that in islam blood money can be accepted and a murderer can go free.
Yes Mike that is the truth, if the family chooses to do so or they can demand the guilty ones life it is up to them.
and that sounds right to you? does that not greatly advantage the wealthy? if a rich person kills a poor person, is it not reasonable to believe the poor family would be more inclined to accept blood money, than say if a wealthly person's son was killed by a poor person? plus where would a poor person get blood money.
what if a spouse didn't like their spouse anyways? that could be a cheap buy out.
and should murderers be allowed to walk free amoung us law bidding citizens just because he was able to convince a poor family to take money?
"me going to jail isn't going to bring your loved one. might as well get a new car out of it?"
"he was the bread winner, ok, how about a new house and car, and $3k a month for the rest of your life?"
so if a father kills his daughter can the wife accept blood money, and the father go free? or vise versa, like the case in pakistan were the mother threw acid on the daughter?
The person does not negoiate any terms, actually their is no negoiations, and yes I think it is right, if that is what the family wants and I think it is right if they want the killer killed. It is there choice.
who sets the terms/price then?
so you disagree with the idea that it is the state vs the defendant. so sharia is based on the laws of vengence, not the idea that laws need to be enforced for communal protection?
The family sets the price Allah says one can take vengence but it is best to show mercy and accept the blood miney. No punishment can be worst than what Allah has.
ok. and bibi's link said it should be reasonable. so is there a set price for a man woman boy or girl? does age come into consideration? status in society? iman is more money than a ditch digger? income? mother more than a childless woman? virgin more than a prostitute. muslim has to be more than a kaffir right?
what if the murderer has killed before?
did you ever see the story of the mennonite whose family was killed by the drunk driver? he said he forgave the man, no blood money, just the old turn the other cheek. or jesus said to forgive. charges weren't dropped. in fact they dragged
him into court against his wishes to testify.
looks like the supreme court of the UAE disagrees with you: "negotiations would continue until the moment of execution, at which the family must be present. He said the Government usually encourages families to accept the blood money, and in some cases the Government itself pays."
a_girl, certainly you have an opinion. no need for scholars. just does it make sense to you. let a murderer go free if he has the money to bribe the vitims family. i mean blood money. it's not a bribe. i guess.
what should happen in your opinion if a father kills his daughter. should he be able to give his wife blood money to make it all go away? plus he could say, or she might figure, if he's in jail who will be her provider?
a- @mikemj, I am not wised up on this subject , other than on the Hadiths, on this subject. Look, all these matters are for logical reasons and with reasoning and wisdom behind them. Not all may understand, only the intelligent. There are 24 Hadiths in bukahri alone, 2 in Sahih, 13 in Dawud and 37 in Malik.
well my logic and reason are certainly below average. my intelligence near bottom of the barrel. and socrates once said i'm a wise man for i know i know nothing. so my wisdom must be like superhuman.
so you are saying you don't understand? why let a murderer go free because of blood money but refuse blood money from a fornicator? you seem to know your hadiths. bukahri 82nd book, limits of punishmints. labourer has sex with guys wife. father of laborer gives guy camels and sheep, thinking son would be stoned. muhammad rules, give stuff back lash boy, stone wife. no adultrus wife blood money?
This subject on blood money is not such a relevant topic that Muslims these days need to know about or use. Perhaps only in the extreme cases. This is why i do not know much as i have no need to go to this subject because i only need what is relevent to me in my situation, as does every body . This is the reason for the Hadiths, the sunnah, the Quran, they are guidence and advice for out lives and what we are gonig through in our calamities or tribulations.
read my link above, from the uae. did you not see the sultan of brunei just implimented sharia in the criminal courts? the salaf are rising in north africa. tunisa, egypt, mali. who knows maybe even morroco will fall to the divine writ of sharia and the hudood. be careful before you leap.
abyadgirl, i admire your tenacity. but your willingness to blindly follow worries me. please, don't just take everything they tell you to heart without question. at least say the dog were hyenias. stripped hyenias range from the arabian penisula to palesitne. or gabe was scared of a puppy in the house.
@mike, my dear, I have been a muslim since 1988, married to an Imam, and have lived amongst many cultures, Asians and Arabs, and of course British born. I am no push over. But my heart is open. And Allah has blessed me. And I could tell you some startling revelations, as witness and testimony of Allahs presence. But this is not the place.
what better place than here? what better time than now? anyway. i think this is why the government sometimes pays the blood money. what do u think
Narrated Sahl bin Abi Hathma:(a man from the Ansar) that a number of people from his tribe went to Khaibar and dispersed, and then they found one of them murdered. They said to the people with whom the corpse had been found, "You have killed our companion!" Those people said, "Neither have we killed him, nor do we know his killer." The bereaved group went to the Prophet and said, "O Allah's Apostle! We went to Khaibar and found one of us murdered."
