respected scholar will touching women without any desire break the state of ablution or wulu?

Salam,

Regarding whether touching woman with desire or without desire lets see what Allah says,

[O ye who believe! Draw not near unto prayer when ye are drunken, till ye know that which ye utter, nor in a state of janabah, save when journeying upon the road, till ye have bathed. And if ye be ill, or on a journey, or one of you cometh from the closet, or ye have touched women, and ye find not water, then go to high clean soil and rub your faces and your hands (therewith). Lo! Allah is Benign, Forgiving] [4 v43] this is the ruling of ghusl to wash the whole body with water when one is in a state of major impurity just like Allah says here, [nor in a state of janabah] and one of the reason of becoming impure is as Allah says here, [or ye have touched women] and when do you become pure is just like Allah says here, [till ye have bathed]

Some scholars have used this [or ye have touched women] as an evidence to say that touching woman breaks your wudu and that they made this as a general ruling, but however this is a weak ruling and the reason been here is that Allah Has mentioned it to mean and Has associated with Jannaba major impurity with touching woman to mean that when you have a sexual intercourse, therefore, making you become in the state of Jannaba and requires you to have a full bath.

There are also a lot of ahadith which shows the Messenger [saw] use to touch his wife's and kiss them and then go out without performing wudu and he would lead the Salah in that state.

Therefore, the majority off scholars have agreed that touching woman whether be with desires or without desires does not break your wudu. Allah knows best.

hanafis say that it breaks your wudu if they arent a mahram since wudu washes away sins they advise people to do wudu if you do anything haram and that inludes shaking the opposite genders hand but if its your wife or sister mother etc. it dosent since you havent sinned

assalam a'likum. I am not a scholar but i toke this in the institute and it is from an old expert scholar (al shafa'ei) : touching women break the ablution to the both because Allah said in sorat al ma'eda <6>[أو لا مستم النساء‏[‏‎ ‎. And it doesn't make sense if it was because of desire or by mistake or you had to or she was (ugly or free or servant) or the man (doesn't have the male device or has or he was odd). And if she is dead and you touch her, your ablution only will be broken and hers won't. That is for foriegn women to you. That is what shafa'e said. Wa allah a'lam
